About these terms
These terms are the agreement between you and Pending publication, the operator of CubicBuilds ("CubicBuilds", "we", "us"). Our details are in the Imprint.
They cover the website cubicbuilds.com, the app at app.cubicbuilds.com and everything we provide through them (the "Service"). By creating an account, buying or using the Service you accept them. If you do not agree, please do not use the Service.
These documents are part of the agreement: the Acceptable Use Policy, the Refund Policy and Copyright and reports. The Privacy Policy and the Cookie Policy explain how we handle personal data.
If you use the Service for a company, a server network or another organization, you accept these terms on its behalf and confirm that you are allowed to.
Who can use CubicBuilds
- You must be at least 16 years old to create an account.
- Only an adult can buy. If you are under 18, or under the age of legal majority where you live, you may only use the Service with the permission of a parent or legal guardian, who accepts these terms for you, is responsible for your use and is the one who makes any purchase.
- The Service is not directed to children under 16. If we learn that a younger child has an account, we close it and delete its data.
- You may not use the Service where the law forbids it, or if you are subject to trade sanctions that forbid us from serving you.
We may ask you to confirm your age or your guardian's permission, and suspend the account until you do.
Your account and your organization
You sign in with a one-time code sent to your email or, where it is offered, with your Discord account. There are no passwords: whoever controls your email inbox or your Discord account controls your CubicBuilds account, so keep them safe.
- Give accurate information and keep your email address up to date: we use it for sign-in and for important notices.
- One account per person. Do not share it or let others use it.
- You are responsible for what happens under your account. Tell us at [email protected] as soon as you suspect someone else has used it.
Work in CubicBuilds happens inside an organization: a personal space, or one shared with a team. Projects, builds, credits and the plan belong to the organization, not to each member. Every member whose role gives access to projects can see all of the organization's projects, and every member can see who the other members are. Its owner and administrators decide who is a member and with which role, and answer for what members do. When a member leaves or is removed, the projects they created stay in the organization.
The Service
CubicBuilds turns a description into a Minecraft build. You describe what you want, an artificial-intelligence system plans and builds it, you see it in 3D, refine it by talking, and export it as a .schem or .litematic file for the Minecraft version of your project.
You are talking to an AI system, not to a person. What it produces is generated automatically: it can be wrong, incomplete, different from what you asked for, or fail to load as expected in a given Minecraft version, server software or tool. Check every build, and test it on a copy of your world with a backup, before using it on a live server.
- Each plan has limits (generations at a time, storage, members, AI modes). They are shown on the pricing page and in the app.
- We may add, change or remove features, Minecraft versions, formats and limits. Changes explains how we tell you about the ones that matter.
- Features marked as beta, preview or experimental may be unstable and may be withdrawn.
- We work to keep the Service available, but we do not promise that it will be uninterrupted or free of errors. It depends on providers we do not control, such as our AI provider and our hosting and network providers, and it needs maintenance from time to time.
Plans, credits and the free trial
Using the AI costs credits. A credit is a prepaid unit of use of the Service. Each generation uses credits according to the work the AI does: when it starts we set aside an estimate and, when it ends, we charge what it actually used and release the rest.
- Free trial. A new personal space may receive a one-time set of trial credits. They expire 14 days after they are granted. One trial per person: creating extra accounts to get more is not allowed.
- Plan credits. A subscription gives the organization credits for each billing period. Unused plan credits carry over to the next period up to the limit shown for the plan; anything above that limit expires.
- Credit packs. One-off credits you can buy with or without a plan. They expire 12 months after purchase.
- Codes. A licence or promotional code can be redeemed once and carries the conditions shown with it.
- Order of use. Trial credits are used first, then plan credits (oldest first), then pack credits.
Credits are not money. They have no cash value, cannot be transferred, resold, gifted or exchanged, are not a gift card, stored value or electronic money, and can only be used inside CubicBuilds by the organization that holds them. They expire as described above, and the app shows your balance. When a plan ends, its features and limits end with it.
When a generation fails because of an outage or an error of our systems or of our AI provider, we return the credits it used. See the Refund Policy.
Payments, renewals and taxes
Paid plans, credit packs and commissions are offered where and when we announce them. This section applies from the moment you can buy.
Purchases are processed by PayNow (PayNow Services, Inc.), which acts as merchant of record and as our commercial agent. PayNow takes your order, charges your payment method, calculates and collects any tax that applies, sends your receipt and handles payment disputes. Paying PayNow counts as paying us, and we remain responsible for providing what you bought.
When you buy, you also accept PayNow's Buyer Agreement and its Privacy Policy, which govern how the payment is taken and your relationship with PayNow. They never reduce what these terms, the Refund Policy or the law give you: when a refund is due, we have PayNow issue it.
- Prices are in US dollars and are shown before you pay. Taxes that depend on where you are may be added at checkout.
- Subscriptions renew automatically. A plan is charged at the start of each billing period, at the price then in force, until you cancel.
- Cancelling. You can cancel at any time through PayNow or by writing to [email protected]. Cancelling stops the next renewal: the plan stays active until the end of the period already paid.
- Price changes. We tell you by email at least 30 days before a new price applies to you. It applies from your next renewal, and you can cancel before then.
- Failed payments. If a renewal cannot be charged, we may pause paid features until it is settled.
- Disputes. If a charge looks wrong, write to us first: we fix genuine mistakes quickly. A chargeback opened without reason may lead us to suspend the account while it is resolved.
Refunds are covered by the Refund Policy.
Commissioned builds
Besides generating builds yourself, you can order a commission: a build that our team prepares for you from your brief, using CubicBuilds' tools.
- Brief. You tell us what you need: the kind of build, its size, style and Minecraft version, references and anything else that matters.
- Acceptance. A commission is accepted when both things have happened: your payment is confirmed, and we have told you in writing that the brief is complete and that we need nothing more from you. We may ask questions first, and we may decline a commission before accepting it; if you have already paid, we refund it in full.
- Delivery. We make the first complete version of the build available to you, in your CubicBuilds project or as a file, in the agreed format.
- Changes. Asking for something new or different after acceptance is a change of brief: it may change the price and the delivery time, and the delivery clock starts again once we accept the new brief.
Accepted commissions carry our 24-hour delivery guarantee. Its conditions are in the Refund Policy.
You are responsible for the brief being accurate and for having the right to use every reference, file or brand you send us. A commissioned build is yours on the same terms as any other build (see Who owns the builds).
Your content
"Your content" is what you put into the Service (prompts and messages, project names, rules and notes, style answers, reference images, schematics and other files) and the builds and renders generated from it.
It stays yours. To run the Service you allow us to store, copy, process, transform, render and display your content, and to send it to the providers that help us run the Service (see the Privacy Policy), only as far as needed to provide, secure and support the Service. This permission lasts while the content is in the Service and for the time we need to delete it afterwards.
Who on our team can see it
- Support staff may open a build to help you or to investigate a problem. Each access is recorded.
- A small number of authorized staff can read the technical log of a generation (your request and the steps the AI took) to diagnose failures or investigate abuse.
- Beyond that, we look at your content only to choose builds for the showcase and options for the style library, to act on reports and signs of abuse, and where the law requires it.
Showcase: gallery and marketing
Unless you opt out, you allow us to show builds made with CubicBuilds, free of charge and worldwide, in our gallery, on our website and social networks and in other promotional material: images, renders, videos and 3D views of the build, with its category, size and Minecraft version, and the request that produced it, edited to remove names and personal details. We do not name you, your organization or your server without your agreement, and we do not offer your build's files for download.
You can opt out at any time, for one build or for all of them, by writing to [email protected]. We stop using them in new material and remove them from our gallery and website within 30 days. Copies already published on networks we do not control, or shared by other people, may remain there.
Style library
Style options that you pick while designing a build (their title, summary, style plan and preview image, never your comments or your personal data) may be added to the shared style library that every customer can choose from. Tell us at [email protected] if you do not want yours to be added.
No model training
We do not use your content to train AI models. Under our agreement with our AI provider, content sent through its service is not used to train its models either.
Your responsibilities
- Only upload content that you have the right to use and that follows the Acceptable Use Policy.
- Do not put personal data about other people, or sensitive information, into prompts or files.
- Keep your own copies of what matters to you by exporting your builds. CubicBuilds is not a backup service.
If you send us ideas or suggestions about CubicBuilds, we may use them without owing you anything.
Who owns the builds
Between you and us, the builds you generate or commission are yours. To the extent the law allows, we assign to you any rights we might have in them. You may use them for any lawful purpose, including commercially: on your server, for your clients or for sale.
- No promise of copyright. In several countries, material generated by AI is not protected by copyright, or only where a person made the creative choices. We cannot promise that your builds are protected, or that you can stop others from copying them.
- Not exclusive. AI can produce similar results for similar requests. Other customers may receive builds that resemble yours, and we make no promise of uniqueness.
- Minecraft belongs to Mojang. Blocks, textures, names and the game itself belong to Mojang and Microsoft. Using a build in Minecraft is subject to the Minecraft EULA and its Usage Guidelines.
- Other people's rights. If your request reproduces someone else's work, brand or character, the result may infringe their rights. That is your responsibility.
CubicBuilds itself is ours: the software, the website, the brand, the mascot, the templates and the style library. These terms give you the right to use the Service and nothing more. You may say that a build was made with CubicBuilds; any other use of our name or logo needs our permission.
Acceptable use
The Acceptable Use Policy says what may not be created with CubicBuilds and how the Service may not be used. In short: nothing illegal, hateful, sexual or infringing; no attempts to break, overload or get around the Service or its limits; no reselling of access; and no use of the AI for anything other than making builds.
We may review content and activity when something is reported or when there are signs of abuse, and act as that policy describes.
Minecraft and other third parties
NOT AN OFFICIAL MINECRAFT SERVICE. NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT.
The Service works alongside products that belong to others, such as Minecraft, Discord, PayNow, and tools like WorldEdit or Litematica. Their own terms apply to your use of them, and we are not responsible for them or for the changes they make.
Suspension and closing accounts
You can stop using CubicBuilds at any time and ask us at [email protected] to delete your account. Export your builds first.
We may limit, suspend or close an account or an organization if it breaks these terms or the Acceptable Use Policy, if a payment is reversed or unpaid, if the law requires it, or if it puts the Service, other customers or third parties at risk.
- Unless the matter is serious or urgent (for example illegal content, fraud or a security risk), we warn you first and give you a reasonable time to fix it.
- We tell you by email what we did and why, and how to ask for a review. You can ask for one within six months by replying to that email or writing to [email protected], and a person will look at it again.
- If we close your account or stop offering the Service without a breach on your side, we refund the unused part of what you prepaid: the remaining time of your plan and the pack credits you bought and did not use.
- If we close it because of a serious breach, we may keep, from what you prepaid, only what covers the harm the breach caused; we refund the rest.
After closure we delete your content as the Privacy Policy explains.
Changes to the Service and to these terms
We may change the Service for good reason: to add or improve features, to follow the law, to keep it secure, to respond to abuse, or because of changes in the technology and the providers it relies on. A change never adds a cost to what you have already paid for.
If a change makes the Service materially worse for you, or if we change these terms in a way that matters, we tell you by email or in the app at least 30 days before. If you do not agree, you can close your account before the change applies and we refund the unused part of what you prepaid. Using the Service after that date means you accept the change.
Changes that the law, a court or a security emergency make urgent may apply at once. The date at the top of this page shows when these terms were last updated.
What we do not promise
We provide the Service with reasonable care and skill. Beyond that, and as far as the law allows, it is provided "as is" and "as available": we do not promise that builds will be accurate, free of errors, fit for a particular purpose, unique or free of third-party rights, or that the Service will always be available.
You decide how to use a build. We are not responsible for what happens when you place it in a world or run it on a server: test it first and keep backups.
If you are a consumer, nothing in these terms takes away the rights that the law of your country gives you and that cannot be waived, including the legal guarantee that a digital service conforms to the contract.
Limits of liability
As far as the law allows:
- We are not liable for indirect or consequential losses, or for lost profits, revenue, players, data or goodwill.
- Our total liability to you for everything related to the Service is limited to the greater of what you paid us in the 12 months before the event that gave rise to the claim, or 100 US dollars.
These limits do not apply to death or personal injury caused by our negligence, to fraud, to intent or gross negligence, or to any liability that cannot be limited by law. If you are a consumer, they apply only where the law of your country allows them: in countries whose law does not let a business limit its liability towards consumers, such as Colombia and Argentina, they do not apply to you.
If you use CubicBuilds for a business
If you use the Service in the course of a business, trade or profession, you will compensate us for claims, costs and damages brought by third parties because of your content or because you broke these terms or the law. This section does not apply to consumers.
Governing law and disputes
If something goes wrong, write to [email protected] first. Most problems are solved by talking, and we aim to answer within 15 business days.
These terms are governed by the law of the country where the operator is established (Pending publication), and its courts are competent, except as said below.
If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country. Nothing here limits that.
We do not take part in voluntary consumer arbitration schemes. Where the law of your country makes a complaints or conciliation procedure mandatory, we take part in it.
General
- Whole agreement. These terms and the documents they mention are the whole agreement between us about the Service.
- If part of them fails. If a court finds a clause invalid, the rest stays in force.
- No waiver. If we do not enforce a right at once, we can still do so later.
- Transfer. We may transfer this agreement to whoever takes over the Service, telling you beforehand; your rights do not shrink. You may not transfer yours without our consent.
- Events beyond our control. Neither of us is liable for failing to do something because of events we cannot reasonably control, such as outages of the internet, of infrastructure or of the providers the Service depends on, attacks, or acts of authorities. This does not change the 24-hour delivery guarantee, which has its own rules in the Refund Policy, or your right to a refund for what we do not deliver.
- Trade rules. You may not use the Service in breach of export-control or sanctions laws.
- Languages. These terms are published in Spanish and in English. If the two differ, the Spanish version prevails, unless the law of your country lets you rely on the version in your language.
- Notices. We write to the email address of your account. You can write to us at [email protected].
